At NILE, we appreciate your use of and contributions to our websites, our mobile and desktop applications, our other properties and/or our related services (collectively known as the “Services,” or, each individually, a “Service”). NILE respects your privacy and is committed to protecting your personal information.

The Services are owned and operated by Nile Technology, Inc. (“NILE”). Notices may be issued to legal@poweredbynile.com

By visiting our websites, using or downloading our apps, or otherwise using any of our Services, you agree that your personal information will be handled as described in this Privacy Policy. Your use of our Services, and any dispute over privacy, are subject to this Privacy Policy and our Terms of Service including its applicable limitations on damages and the resolution of disputes. The NILE Terms of Service are incorporated by reference into this Privacy Policy.

CHANGES TO OUR PRIVACY POLICY 

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice on www.poweredbynile.com, by sending you an email, and/or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.

CHILDREN UNDER THE AGE OF 16

NILE will not knowingly collect personally identifiable information from any person under the age of 16. The Services are not designed to attract the attention of persons under the age of 16.  We understand and are committed to respecting the sensitive nature of children’s privacy online. If we learn or have reason to suspect that a user of the Services is under age 16, we will promptly delete any personal information in that user’s account.

TYPES OF INFORMATION WE COLLECT

Information You Provide. 

We collect content, images, and other information you provide to us when you access our Services, including when you complete webforms on www.poweredbynile.com; create an account with us; communicate with us about our Services via comments, direct message, e-mail, SMS message, or telephone; or respond to one of our surveys. We collect personal information from you such as email address, phone number, or mailing address when you request information about or use our Services, register for our newsletter or loyalty program, request customer or technical support or otherwise communicate with us. 

OTHER CATEGORIES OF INFORMATION WE COLLECT

General.  Other information we collect includes: Your account log-in details; Financial information, including bank account and real estate financing information; Details about your home and neighborhood; Circumstances related to your purchase or sale of a home that might help us tailor our Services to you; Homes you visit or view on our website or mobile application and your opinions about those homes; Reviews or comments you leave on our website, mobile application, or on other public websites; Your driver’s license or state ID information; Citizenship status (for tax calculation purposes); and Marital status (for tax calculation purposes).

Property Information.  Through the Services you can submit information about properties you identify, such as properties you view, save, or seek to sell or buy.  In this case, we may collect information including addresses, prices, photos, and other information about the properties. In addition, we may collect information about the appointments you schedule, offers you place, counter or accept, and property notes you make.  We associate the property information with your account.

INFORMATION WE COLLECT FROM PARTNERS, SERVICE PROVIDERS, AND AFFILIATES:

We may collect information about you from our partners, service providers, and affiliated businesses in order to provide the Services, along with certain related products and services such as home financing, homeowners insurance, title insurance, escrow services. Information we gather about you from our partners, service providers, and affiliated businesses may include:

Multiple Listing Service (MLS) information about your home or the home(s) you are interested in buying; Prequalification letters from financial institutions (with your consent); Construction or purchase contracts (with your consent); Information related to completion of the construction of your new home (if you are working with a homebuilder and you agree); Information about the condition of, and repairs to, your home and property; Information related to your home purchase, sale, moving dates, and financing in connection with helping us facilitate “trade-in” deals; Information about whether you may need homeowners insurance; and Information about how you engaged with an NILE advertisement or social media post.

Affiliated Businesses: In certain situations, businesses or third party websites we’re affiliated with may sell or provide products or services to you through or in connection with the Services (either alone or jointly with us). You can recognize when an affiliated business is associated with such a transaction or service, and we will share your Personal Information with that affiliated business only to the extent that it is related to such transaction or service. One such service may include the ability for you to automatically transmit Third Party Account Information to your Services profile or to automatically transmit information in your Services profile to your third party account. We have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business’ or websites’ policies.

INFORMATION WE COLLECT FROM PUBLIC SOURCES

Much of the information necessary to help you buy or sell your home is available from public government sources. We sometimes collect information from these sources so that you do not have to spend time looking for and aggregating it for us. For example, we may collect the following information about you and your home from public sources:

Tax assessments of your property; The school district and public transportation available near your home; Information contained on the deed to your property, such as name, address, liens, encumbrances, and title; Sale prices of homes similar to your home (called “comparables”);The number of bedrooms and bathrooms in your home;  Whether your home has access to features like a beach, boat dock, or parking garage; Whether your home is in an earthquake or flood zone or has any other condition that would affect its market value; Permits issued for remodels and additions;  The finished and unfinished square footage of your home; and  The year your home was built.

INFORMATION COLLECTED AUTOMATICALLY 

Whenever you interact with our Services, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, device identification, “cookie” information, the type of browser and/or device you’re using to access our Services, and the page or feature you requested. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Services are visited and by how many people. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our features.

THIRD PARTY SERVICES

If you click on a link to a third party website or service, a third party may also transmit cookies to you. Again, this Privacy Policy does not cover the use of cookies by any third parties, and we aren’t responsible for their privacy policies and practices. Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Services, and those third parties may not honor “Do Not Track” requests you have set using your browser or device.

BEHAVIORAL ADVERTISING 

We may participate in behavioral advertising. This means that, for example, when you use the Services, we or third party service providers or advertisers may use cookies or other similar technologies to collect information about your use of the Services (including mobile applications) or your online activities over time and across different Web sites. Collected information may include the content you view, the date and time that you view this content, and the Web site that referred you to the Services, and this information may be associated with your unique browser, device identifier, or Internet Protocol address. These practices help tailor advertisements that are relevant and useful to you. These tailored advertisements may appear on the Services or on other websites, applications or properties.

OTHER USES

We may disclose personal information that you provide via the Services in the event of a merger, acquisition, or any form of sale of some or all of our assets, in which case personal information we collect via the Services will be among the assets transferred to the buyer. Further, we may disclose your personal information to third parties to: Comply with any court order or other legal obligation; Enforce or apply our terms of use and other agreements; Protect the rights, property, or safety of our business, our clients, customers, employees, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection, information security, and other related matters.

AGENTS:

We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Unless we tell you differently, our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us.

CALIFORNIA PRIVACY REGULATION:

Under the California Consumer Privacy Act (“CCPA”), California Civil Code Sections 1798.100. – 1798.199, California residents are entitled to certain rights with respect to their personal information.  If you are a California resident, this section applies to you.

We have collected the following categories of personal information about our users in the last 12 months, using the categories provided in the CCPA: 

  • identifiers such as your name, alias, address, phone numbers, or IP address;
  • personal information, such as a credit card number;
  • age, gender, or other protected classifications;
  • commercial information, such as products or services purchased;
  • Internet or other electronic network activity information, including your interactions with our website and other services;
  • biometric information, i.e., your physiological, biological or behavioral characteristics;
  • geolocation data, such as the location of your device or computer;
  • professional or employment-related information; and
  • inference data, i.e., inferences about your preferences based on other information we’ve collected.

We collect and use these categories of personal information for the business purposes described above. We do not sell your personal information. We do not offer financial incentives to consumers as compensation for the disclosure, deletion, or sale of personal information about them.  

Subject to certain limitations, you have the right to (1) request to know more about the categories and specific pieces of personal information we collect, use, and disclose about you, (2) request deletion of your personal information, (3) opt out of any sales of your personal information, if we engage in that activity in the future, and (4) not be discriminated against for exercising these rights. If we receive your request from an authorized agent, we may ask for evidence that you have provided such agent with a power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. This may include requiring you to verify your identity. If you are an authorized agent seeking to make a request, please contact us using one of the methods described above.

STORAGE, SECURITY AND RETENTION OF INFORMATION

Personal Information will be processed and stored by NILE in databases hosted in the United States. NILE has taken reasonable steps to protect the information users share with us, including, but not limited to, setup of processes, equipment and software to avoid unauthorized access or disclosure of this information. No transmission of information via the Internet can be entirely secure, however, so please always use caution when submitting Personal Information.

We will retain your Personal Information for as long as you have an active account, as needed to provide you with the Services, to comply with our legal, financial reporting, or compliance obligations, and to enforce this privacy policy.

You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our features.
